These Affiliate Terms & Conditions govern participation in the TeachSmartHQ Affiliate Program. By applying to, joining, or participating in the program, you agree to follow these terms, our platform rules, and any reasonable affiliate guidance provided by TeachSmartHQ.
Important: These terms are intended to protect the integrity of the TeachSmartHQ Affiliate Program, our customers, and our brand. Approval into the program does not create an employment, partnership, franchise, agency, or joint venture relationship between TeachSmartHQ and any affiliate.
1. Acceptance of terms
By submitting an affiliate application, accepting approval into the TeachSmartHQ Affiliate Program, accessing the affiliate portal, or promoting TeachSmartHQ through an affiliate link, you agree to be bound by these Affiliate Terms & Conditions, any related program policies, and any additional instructions or requirements reasonably issued by TeachSmartHQ.
If you do not agree with these terms, you should not apply to the program, access the affiliate portal, or use any TeachSmartHQ affiliate links, branding, or promotional materials.
2. Eligibility and approval
All affiliate applications are subject to review and approval at TeachSmartHQ’s discretion. We may accept, reject, limit, or remove any application or account for any lawful business reason, including brand fit, promotional methods, audience quality, incomplete information, suspicious activity, or compliance concerns.
Approval is not guaranteed. Affiliates must provide accurate and complete information during the application process and keep relevant account information reasonably current.
TeachSmartHQ may request clarification about your promotional channels, audience, traffic methods, or intended use of affiliate links before or after approval.
3. Commission structure
Approved TeachSmartHQ affiliates currently earn a 30% commission on qualifying referred sales that are properly tracked through the affiliate system and remain valid under these terms.
Qualifying sales
A qualifying sale generally means an eligible purchase completed through a valid referral path that is successfully tracked, not fraudulent, not self-referred, not refunded, and not otherwise excluded under these terms or current program settings.
Commission limits
Commissions are earned only when the affiliate system attributes the sale to the approved affiliate under the active tracking configuration. TeachSmartHQ may review any referral before final payout approval.
TeachSmartHQ may update commission rates, eligible products, payout structures, qualification rules, or referral windows at any time. Updated program terms will apply going forward once posted or otherwise communicated.
4. Tracking and attribution
The affiliate program relies on referral links, cookies, tracking parameters, and related technologies to attribute eligible sales. TeachSmartHQ will use the tracking data available through its affiliate system to determine which affiliate, if any, is credited for a referral.
Tracking may be affected by browser settings, device switching, privacy tools, cookies being cleared, ad blockers, user actions, technical interruptions, or other factors outside TeachSmartHQ’s control. As a result, TeachSmartHQ cannot guarantee that every click, visit, or sale will be tracked in every instance.
The records in the TeachSmartHQ affiliate system will generally control for purposes of determining referrals, commissions, reversals, and payout eligibility.
5. Payments and payouts
Approved commissions are paid according to the current TeachSmartHQ affiliate payout process. Payout timing may depend on factors such as transaction validation, refund periods, fraud review, account standing, and minimum payout thresholds if applicable.
TeachSmartHQ may delay, withhold, adjust, or deny payouts where reasonably necessary to review disputed referrals, suspected fraud, policy violations, chargebacks, excessive refund activity, incomplete payout information, or other program integrity concerns.
- Payouts apply only to approved, non-reversed commissions
- Affiliates are responsible for providing accurate payout details if requested
- TeachSmartHQ may require reasonable identity or account verification before payout
- Any taxes, reporting obligations, or financial responsibilities associated with affiliate earnings remain the affiliate’s responsibility unless applicable law requires otherwise
6. Promotional rules
Affiliates may promote TeachSmartHQ through approved channels and ethical marketing practices that align with the brand, the education-focused audience, and applicable law. Affiliates must present TeachSmartHQ honestly and may not make deceptive, misleading, or exaggerated claims about products, results, pricing, access, guarantees, or business relationships.
Affiliates are expected to:
- Use truthful descriptions of TeachSmartHQ products, offers, and pricing
- Promote in ways that are professional, brand-safe, and appropriate for educators and related audiences
- Comply with applicable advertising, disclosure, privacy, and consumer protection laws
- Clearly disclose affiliate relationships when required by law or platform rules
- Use current landing pages, approved links, and accurate information when possible
7. Prohibited conduct
The following activities are prohibited and may result in rejected commissions, account suspension, or immediate termination from the program:
Traffic and promotion violations
- Spam, unsolicited bulk messages, or abusive outreach
- Misleading ads, fake scarcity, or deceptive landing pages
- Using unauthorized coupon, discount, or rebate claims
- Trademark misuse, impersonation, or pretending to represent TeachSmartHQ directly
Referral manipulation
- Self-referrals or attempts to earn commission on your own purchases
- Cookie stuffing, forced clicks, hidden redirects, or tracking manipulation
- Fraudulent transactions, fake leads, fake customers, or artificial traffic
- Using bots, scripts, or other tools to interfere with program integrity
TeachSmartHQ may investigate suspicious activity and make final determinations about account compliance, referral validity, and commission eligibility using its own records, tools, and reasonable business judgment.
8. Brand and content usage
Affiliates may use TeachSmartHQ-provided names, links, and promotional materials only for the limited purpose of participating in the affiliate program and only in a way that remains accurate, professional, and consistent with the brand.
Affiliates may not:
- Edit or misuse TeachSmartHQ logos, trademarks, or brand assets in misleading ways
- Create websites, pages, domains, social handles, or advertisements that impersonate TeachSmartHQ or cause likely confusion
- State or imply an employment, sponsorship, ownership, endorsement, or partnership relationship that does not exist
- Publish claims about TeachSmartHQ offers that are no longer current or that were never approved
All TeachSmartHQ brand assets, materials, and site content remain the property of TeachSmartHQ or its licensors. Participation in the affiliate program does not transfer ownership or create any broader license rights beyond permitted affiliate use.
9. Refunds, cancellations, and reversals
If a referred transaction is refunded, reversed, canceled, charged back, found to be fraudulent, or otherwise determined not to qualify, the related commission may be reversed, reduced, withheld, or excluded from payout.
TeachSmartHQ reserves the right to correct commission errors, adjust account balances, and offset prior overpayments against future commissions where appropriate.
10. Suspension or termination
TeachSmartHQ may suspend, limit, or terminate any affiliate account or access to the program at any time, with or without prior notice, for any lawful business reason, including inactivity, compliance concerns, reputational risk, fraud suspicion, prohibited conduct, or violation of these terms.
Upon suspension or termination, TeachSmartHQ may deactivate affiliate links, restrict portal access, review pending referrals, cancel unpaid or invalid commissions, and take any other reasonable action necessary to protect the business and program integrity.
11. Program changes
TeachSmartHQ may modify, pause, replace, or discontinue any part of the affiliate program at any time. This includes, without limitation, changes to commission rates, eligible products, referral windows, payout methods, approval standards, portal functionality, promotional rules, and related program documents.
Updated terms may be posted on this page or otherwise communicated through the affiliate portal, website, or reasonable program communications. Continued participation after such updates may be treated as acceptance of the revised terms.
12. Disclaimers and limitation of liability
The TeachSmartHQ Affiliate Program, affiliate portal, links, tracking systems, and related materials are provided on an “as is” and “as available” basis to the extent permitted by law. TeachSmartHQ does not guarantee uninterrupted availability, error-free operation, or guaranteed affiliate income.
To the fullest extent permitted by law, TeachSmartHQ will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising out of or related to the affiliate program, even if advised of the possibility of such damages.
In all cases, TeachSmartHQ’s total liability relating to the affiliate program will be limited to the amount of unpaid, properly approved commissions, if any, that are lawfully owed to the affiliate for valid referral activity under these terms.
